These Terms of Service (“Terms”) govern access to and use of the Red Flannel Intelligent Virtual Assistant (“RF IVA”, “the Service”) provided by Red Flannel Solutions (“we”, “us”, “our”). By using the Service, you agree to these Terms.

RF IVA provides an intelligent virtual receptionist and related scheduling features for businesses, including phone call handling and optional calendar connectivity (such as Google Calendar and Microsoft 365) to propose and create appointments.
You must have authority to bind the business that uses the Service. You are responsible for users you authorize, for protecting credentials, and for configuring connected calendars and phone routing correctly.
The Service may interoperate with third parties (for example Google, Microsoft, telephony carriers, and voice providers). Your use of those services is also subject to their terms and policies. We are not responsible for third-party outages or policy changes.
Our collection and use of personal data is described in our Privacy Policy. You instruct us to process data as needed to provide the Service.
We retain all rights in the Service, software, and branding. You retain rights in your content and customer data. You grant us a limited license to process that data solely to operate the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CALLS, TRANSFERS, OR BOOKINGS WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
We may suspend or terminate access for misuse, non-payment, security risk, or legal requirements. You may stop using the Service at any time and may disconnect third-party accounts.
We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules, unless a mandatory local law provides otherwise.
